These Global Terms and Conditions of Sale ("Terms") apply to all purchases made through the Huda Beauty e-commerce website(s) and any associated digital platforms (collectively, the "Website") globally. By placing an order, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into a binding contract. When these Terms mention "Huda Beauty," "we," "us," or "our", it refers to the Huda Beauty Group of Companies, as defined in our Privacy Policy ("HUDA BEAUTY"). If you use any of our services, we will refer to you by using the terms "user", "visitor", "you", "your", "yours" in these Terms.

Depending on your location, additional mandatory consumer rights may apply.

This website is owned and run by HB FZ LLC. ("Us" or "We"). We are a company incorporated in the Dubai Multi Commodities Centre (HB FZ LLC) with company number HB FZ LLC23301 and have our registered office at 2101 JBC 3, Cluster Y, Jumeirah Lakes Towers, Dubai, United Arab Emirates. TERMS OF SALE

By placing an order, you are offering to purchase a product on and subject to the following Terms. A legally binding contract is formed only when we dispatch your order and send you a dispatch confirmation email. We reserve the right to refuse or cancel orders prior to dispatch. An acknowledgement of your order is not an acceptance of your order. We may decline to accept an order for any reason, including but not limited to unavailability of stock, inability to obtain payment authorisation, or suspected fraud.

All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from, inter alia, postal delays or force majeure for which we will not be responsible. You must be 18 years old or the age of majority in your jurisdiction to make a purchase on our Website. If you are under 18 years old or the age of majority in your jurisdiction, then you may not make a purchase on our Website. If you are under 13 years old, you may browse our Website. However, you may not provide personal information to us, make a purchase on the Website nor register on the Website, and can only do so at the age of majority in your jurisdiction. This Website is not directed to children under 13 years old. By accessing or using the Website, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms.

Huda Beauty retains the right to refuse any request made by you and reserves the right to close your Huda Beauty online account at our sole discretion. If your order is accepted, we will inform you by email. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit card, debit card, payment account or payment platform used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Website may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18s.

OUR CONTRACT AND HOW THE CONTRACT IS FORMED

After placing an order, you will receive an email from Huda Beauty acknowledging that we have received your order (the "Order Confirmation").

Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product or service. All orders are subject to acceptance by Huda Beauty, and we will confirm such acceptance to you by sending you an email that confirms that the products have been dispatched (the 'Dispatch Confirmation'). The contract between us (the "Contract") will only be formed when we send you the Dispatch Confirmation. The Contract will relate only to those products whose dispatch we have confirmed.

NO RESALE POLICY

You agree that all products and services purchased through our website are intended for personal use and not for resale. We strictly prohibit the purchase of product for commercial resale or distribution. By placing an order, you represent and warrant that you are buying products for your own personal and/or professional use and not for resale.

We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household, or per order. These restrictions may include orders placed by or under the same account number, the same payment method, and/or orders that use the same billing or shipping address.

If we reasonably believe that your order has been made with the intent to resell, we reserve the right to cancel the order, suspend or terminate your account, and take any legal action necessary to enforce this policy.

HUDA'S VIPS

What is Huda's VIPs?

Huda's VIPs is our Rewards Program. For your continued loyalty, we're giving you access to exclusive offers, unique rewards & other beauty benefits. You must first create an account on hudabeauty.com and then join and agree to participate in the loyalty program by accepting these Terms & Conditions. Until you accept these Terms & Conditions, your loyalty account will remain in pending status and will not be fully active. While your account is pending, you will continue to earn points for any orders placed, but you will not be able to redeem these points or access any other loyalty benefits until your account is activated.

There are 3 loyalty tiers as part of the Rewards Program:

  • Tier 1: BRONZED BEAUTY
  • Tier 2: SILVER SIREN
  • Tier 3: GOLDEN GODDESS

Your tier will be defined by the amount that you spend in a year. As you move up the VIP Tiers, you will be entitled to more exclusive benefits and offers. You can check out our Rewards Page for full info on what's included in each tier. You can view your current status, points balance, and how much you need to spend to reach the next tier within your Huda's VIPs account page. You can learn more about Huda's VIPs HERE.

You must continue to spend the qualifying amount (at any given 365 days) to remain in your tier. Please see below qualifying spend per tier:

How do you earn points?

Earning points is easy! Every time you shop on hudabeauty.com and are logged into your Huda's VIPs account, you will earn points on eligible purchases.

Points can be earned on products from the brands Huda Beauty, Wishful or Glowish only. Please note that purchases of any brand collaborations such as (but not limited to) Beauty Works will not earn points. Points are also only earned on the price you have paid for the product (which may be lower than the advertised costs). To view how many points you will earn you can check out the Huda's VIPs Rewards page. Huda's VIPs Rewards Program is exclusive to hudabeauty.com so you will not earn points for Huda Beauty products purchased from any other retailers.

Your points will be added to and appear on your account balance two days after your order is placed. If a purchase is refunded for any reason, the associated reward points will be deducted from your point balance. This includes bonus points associated with the purchase. If we add points to your account manually, the points will contribute to your point balance but not contribute to your tier increment.

If you have enough points available to redeem a discount on your order, you will see the option to 'Redeem Your Points' at checkout. You must be logged into your Huda's VIPs account for this to be available. You can select the amount you would like to redeem from the dropdown on the checkout page. This will auto apply your Rewards Discount Code to your order, and you will see the discount being applied to your cart. If for any reason, you don't complete your order at this stage you will be able to view your Rewards Discount Code when logged in to your Huda's VIPs account and you can use this on your next order, just enter the code in the coupon code box at checkout. You can also earn bonus points from time to time. To keep up to date with any bonus points available and the rewards available, check out our rewards page. You may only use one code per order, so please only 'Redeem your points' in exchange for your code when you intend to make a purchase.

When you select 'Redeem your points' your points will be exchanged for a coupon code that can be entered at checkout to get your discount. All redemptions are final and non-reversible*. Again, you may only use one code per order, so please only redeem your points in exchange for your code when you intend to make a purchase. Within the Terms of each promotion, you will be able to check whether Huda VIP's Rewards can be redeemed. [*If you do not proceed with your order, the promo code will be saved in your Rewards page or at checkout for future purchases, if you're logged in to your Huda's VIPs account. However, it cannot be converted back into points.]

You need at least 150 points to redeem points against an order. For example:

  • 150 points will get you $15* off your order
  • 300 points will get you $30* off your order
  • 450 points will get you $45* off your order

[All point earn rates are standardized across all currencies, using USD as the base currency. Currency conversions are calculated using live exchange rates sourced from XE Foreign Exchange and may vary based on real-time market fluctuations. For example, a spend of £0.74 GBP earns 1 point.]

Coupon codes issued for Huda's VIPs Rewards can be used on all applicable products (all Huda Beauty, Wishful and Glowish products) even on sale items (subject to change). If your cart includes a regular priced product and your Huda's VIPs reward code and cannot be redeemed, please check the code has been entered correctly then send us a screenshot of the error you have received and details of your code so we can check this for you.

Your points will expire 365 days after they are earned, if they are not redeemed, and they cannot be reinstated. If a purchase is refunded for any reason, the associated reward points will be deducted from your point balance.

How do I opt out of Huda's VIPs Rewards program?

To un-enroll for any reason, please submit your request via email at [email protected] and within thirty (30) business days, your Huda's VIPs account will be deactivated.

Once your account is deactivated, any unused points will be forfeited and may not be reinstated even if you re-activate your Huda's VIPs account later. Please note that un-enrolling in Huda's VIPs only unsubscribes you from the loyalty program, however, may not automatically result in deletion of your other personal data elsewhere on our website (e.g., shipping and credit card information).

COUPON CODES

Coupon codes may only be valid on certain products. They will not be valid on any product contained in the 'New' category on the website or products which are already discounted as part of a sale or promotion. This includes items as part of a promotion, Gift Sets, Value Sets, and Build Your Own Sets. Coupon Codes are also not applicable on any other brand collaborations. The codes will only apply to full price Huda Beauty, Wishful or Glowish products, and will not be valid if there is already another coupon code added to the cart.

Wondering where you enter your coupon code? After adding your items to your basket, click the option VIEW CART. You can then insert your code on the field that says ENTER PROMO CODE. If you entered your email address to receive a welcome coupon code, it should have been automatically emailed to you. If not received; firstly, please ensure your email address was correct and check your spam or junk folder too. If still not received within 24 hours just let us know.

*This refers to all coupon codes other than those exchanged from Huda's VIPs points

FREE GIFT PROMOTIONS

From time to time, we may run promotions which offer a Free Gift when you make a purchase on the Website. Such promotional offers are typically for a limited time and may be communicated via our subscription marketing emails, SMS or may be advertised directly on the Website. Any such promotion shall be subject to its own specific terms, but typically will include one or more of the following:

  • The 'Free Gift' item/s should be visible on your cart at checkout – if the item/s are not in your cart, the item/s will not be included in your order. Please ensure all applicable 'Free Gift' items are on your cart before completing your order. We will not be responsible if these are not added to your order.
  • Offers are available whilst stocks last.
  • Exclusions may apply.
  • If the item you have paid for is eligible for return, and you wish to return it, any 'Free Gift' item/s offered as part of the promotion must also be returned, or you may not be eligible for a refund.
  • Coupon codes may not be eligible alongside 'Free Gift with Purchase' offers (this excludes codes issued in exchange for loyalty points, if your loyalty code does not work, please let us know).
  • Promotional prices and offers cannot be reinstated after the promotion have ended. Coupon codes that are not eligible at the time of purchase cannot be exchanged for a refund.

PRICING AND WEBSITE ERRORS

Whilst we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, typographical errors or other errors and may not always be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to cancel or complete delivery of any orders that you may place based on information on the Website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and a refund will be processed. You can then choose if you wish to place a new order at the correct price. When ordering products or services through the Website, please note that:

  • Orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this Website;
  • All prices are displayed in your local currency and local tax where applicable unless expressly indicated otherwise;
  • Packaging may vary from that shown on the Website;
  • The weights, dimensions and capacities shown on the Website are approximate only;
  • Whilst we try to display the colours of our products accurately on the Website, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery; and
  • All items are subject to availability. We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer alternative product(s) or service(s) of equal or higher quality and value.

Prices on the Website may include applicable taxes depending on the destination, but exclude delivery costs, which will be added to the total amount due (if applicable). Prices are liable to change at any time, but (other than as set out above) changes will not affect orders in respect of which we have already sent you an Order Confirmation. The countries where tax would NOT BE added are mentioned on our FAQ page.

You may pay using your debit or credit card, or other available payment methods on the website. Your credit/debit card payment will be made through a secure transaction. All payments are subject to authorisation by the card issuer. Card payments are subject to validation checks and authorisation by your card issuer. If your card issuer fails to authorise the payment to us, we will not be liable for any delay or non-delivery and may not be able to form a Contract with you or we will not be able to proceed with your order. Huda Beauty must receive full payment for the order at the time the order is processed and before the product is dispatched. A Dispatch Confirmation email will then be sent you.

PAYMENT

The Website currently hosts various currencies on the website. If your local currency is not applied on your order, you will be charged in the default currency which is USD. The currency conversion will then be applied by your issuing bank. You can pay on the Website using a credit or debit card, or any other available payment method. If you select to pay with card, you can pay with Visa, Mastercard, Diners, Discover, American Express, UnionPay (Available for UK only), Maestro (Available for UK only) and Cartes Bancaires (Available for EU only). Upon receiving your order, we carry out a standard pre-authorisation check on your payment card to ensure that the payment details match the cardholder and that there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

All payment information is processed securely by our third-party payment processors; we do not store your full card details. We reserve the right to cancel any order where we suspect fraudulent activity and to refer such matters to the relevant authorities.

Personal information provided during the order and registration process as a HudaBeauty.com customer should be true, accurate, current, and complete in all respects. If any information changes, please contact our Customer Service team at [email protected] or update your online account details accordingly.

GENERAL ONLINE RETURNS POLICY

Subject to the exceptions listed HERE and market-specific rules set out below, you may return eligible products within 30 days from the date of delivery, provided that: (i) the products are unused and in their original, unopened and resaleable condition; (ii) all original packaging, seals and labels are intact; and (iii) you have proof of purchase. For the avoidance of doubt, no opened product may be returned except where the product is damaged, defective, materially different from its description, or has caused an adverse skin or physical reaction (together, "Defective Products"). Where a Defective Product claim is made, we may require evidence of the defect (such as photographs) prior to approving a return. Refunds will be credited to the original tender used to process the payment. Purchase of items using Afterpay or Klarna does not affect your eligibility to return. The cost of postage for returning the item(s) is not refunded.

If you have returned your item using the pre-paid label provided by Huda Beauty, it will be checked and verified at our warehouse. If all the return requirements have been met, your refund should be processed within 14 days of the items being received. Once your refund has been processed, it can take up to 14 days to reflect with your issuing bank. If you can see that your return items have been received and this date has now passed, just let us know so we can look into this for you. If your items are eligible for return, we recommend that you use the return label provided by Huda Beauty as we cannot reimburse you for the return shipping cost if the pre-paid label was not used. If, however, you have returned your items using an alternative return label, please also provide tracking details when you get in touch.

FRAGRANCE/PERFUME RETURNS

Due to hygiene and safety considerations, fragrance and perfume products ("Fragrance Products") are subject to the following market-specific rules:

(a) United States, United Kingdom, European Union member states, Norway, Switzerland, Canada, Australia, United Arab Emirates, Saudi Arabia, Kuwait, and South Korea: Fragrance Products may be returned within 30 days of delivery provided they are unused, in their original sealed packaging with all seals unbroken, and accompanied by proof of purchase.

(b) All other markets: Fragrance Products may only be returned if they are Defective Products. Returns of Fragrance Products for any other reason will not be accepted.

(c) Once a Fragrance Product seal has been broken or the product has been used, it cannot be returned under any circumstances except as a Defective Product.

Notwithstanding the above, your statutory return and remedy rights under applicable local consumer protection law are not affected or limited by these Terms. Where mandatory local law provides for broader return or refund rights than those set out above (including in respect of Fragrance Products), those rights will prevail to the extent required by law. To initiate a return, please contact our Customer Services team at [email protected] before sending any item back. Unauthorised returns may be refused.

REFUNDS

If you receive an email to inform you that your order was unsuccessful and has been cancelled, it is unlikely that any money was transferred from your account. An authorisation may have occurred, which is just a temporary hold on the funds, and no money has been transferred. In this scenario the hold will be lifted automatically within 48 hours, however this may take longer to reflect with your issuing bank. If you have any concerns or questions to whether your card was charged or 'authorised', just let us know.

If any items in your order have been received in an unsatisfactory condition, please let us know within 14 days of your order being delivered. Please send your order number, and clear photos of the damaged item alongside your pack slip via email at [email protected]. Please note we cannot consider cases reported after 14 days of the receipt of your items. Please do not dispose of the items as you may need to return them to be eligible for a refund. If you have any further queries regarding an online return, please contact us at [email protected].

In case of missing items or lost packages, please let us know within 14 days of your order being delivered. Please send your order number, and clear photos of the items received (in case of missing items) via email at [email protected]. Please note we cannot consider cases reported after 14 days of delivery.

EXCHANGES

For hygiene purposes we do not have an exchange policy, any items that are eligible to be returned can be returned for a refund only. If you need an alternative product, you will need to return the items first and then place a new order.

CANCELLATION REQUESTS

Unfortunately, we cannot always accommodate cancelation requests. We will try our best to assist but after a certain stage of order processing, it can no longer be cancelled. We aim to ship orders as fast as we can so although you may message us immediately after placing your order, unfortunately it doesn't always guarantee cancelation. The cancelation request has to be reviewed and the request is sent to our warehouse processing team. If you would like to attempt cancelation of an order, please send us an email from the email address registered on your order along with the order number to be cancelled and include the message: Please Cancel My Order. This will help us prioritise your email. You can do this by emailing us at [email protected]. If we are unable to cancel your order, your items may still be eligible for return, you can check out our returns policy here.

STOCK AVAILABILITY

All orders for products are subject to availability and in this regard, in the event of supply difficulties or because products are no longer in stock, we will send you an email advising you that we are unable to fulfil your order or one of our Customer Service team will contact you.

Free samples and 'Free Gift' item/s offered at checkout are not guaranteed.

REFUSAL OF ORDER

Huda Beauty reserves the right to withdraw any products from this Website at any time and / or remove or edit any materials or content on this Website. Whilst we will use our reasonable endeavours to authorise payments submitted to us, there may be exceptional circumstances which mean that we may need to refuse to process or accept an order after we have received it or sent you an acknowledgement of receipt, which we reserve the right to do at any time, at our sole discretion. Huda Beauty will not be liable to you or any other third party by reason of our withdrawing any product from this Website, removing or editing any materials or content on this Website or for refusing to process or accept an order after we have received it or sent you an acknowledgement of receipt.

Where Huda Beauty reasonably believes that a refund, return or replacement request is misused, made in bad faith or fraudulent, Huda Beauty reserves the right to (i) refuse the return, refund or replacement request, (ii) cancel any future orders and (iii) block the account from making future purchases.

FREE SHIPPING SERVICE

By taking advantage of the Free Shipping Service, you agree to the following Terms:

Currently, free shipping on HudaBeauty.com orders will be applied on orders over the amounts specified on the homepage of your shipping destination. This will be applied on the currency displayed on your order, not based on conversion and is subject to change. This offer will be applied automatically at the checkout. The free shipping threshold is calculated after any discounts have been applied, and before any taxes, duties or fees are added at checkout. This may vary during promotions and sale periods. *USD threshold may vary based on shipping address.

Otherwise, delivery charges apply. The cost of shipping will depend on your delivery address. After entering your delivery address at checkout, you will be able to view the delivery options available to you and their cost.

Huda Beauty reserves the right to (i) cancel this free shipping service and (ii) amend these Terms at any time.

YOUR ORDER DELIVERY

Subject to the STOCK AVAILABILITY clause above, we will endeavour to fulfil your order for product(s) listed in the Order Confirmation within a reasonable period unless there are exceptional circumstances that are out of our control. In these cases, we will endeavour to deliver your order as soon as possible. Once your order has been dispatched, we will email you the details of your order to the email address provided.

For the purpose of these Terms, "delivery" or "delivered" shall be deemed to have occurred upon delivery of the product(s) at the address specified by you when you completed your order. Huda Beauty will not be responsible for any orders that are delivered to the incorrect address provided at the time of placing the order.

If you wish to send products to different addresses, you must create a different order for each delivery address.

INTERNATIONAL DELIVERY

Requests to update your shipping address are not guaranteed regardless of when the request is made. We will attempt to change delivery if the order has not yet been processed, but if this is unsuccessful, we will deliver the order to the shipping address stated on the order. Huda Beauty will not be responsible for any charges for address changes made to the carrier or for any orders that are delivered to the incorrect address provided at the time of placing the order.

Unfortunately, we are unable to combine your orders for delivery, if you place multiple orders they will be shipped separately, we are so sorry we are unable to assist further with this request.

Delivery: We use various delivery carriers depending on the region. You can check the carrier we use for deliveries to your country HERE.

APO addresses: We can only offer delivery to APO addresses within the US. Orders will be delivered by USPS and delivery may take up to 14 days. Unfortunately, we cannot ship fragrance or any HAZMAT items to an APO address.

Some countries may be required to pay tax & duties upon arrival which will be applied by your local customs office. Local duties, taxes, and customs charges may apply and are not included in the order total. Where applicable, these charges may be calculated based on the order value before any discounts or promotions are applied. For delivery to any of the countries listed HERE any applicable tax & duty would have been charged at checkout and you should not be subject to any additional charges.

Your local customs office may also apply sales tax & duties against the full retail value of the complementary or discounted item. They will review the value of the product at retail price and not view this as a 'free' or discounted item.

Please be aware that just because you may qualify for free shipping based on your order value, this does not exempt you from potentially having to pay duties and taxes, as these are imposed by customs authorities in your country and not Huda Beauty.

INTELLECTUAL PROPERTY
